Agreement to Terms

By downloading, installing, or using the FreshScan mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

We reserve the right to modify these Terms at any time. Your continued use of the App following any changes constitutes acceptance of those changes.

Description of Service

FreshScan is a mobile application that uses artificial intelligence to:

• Identify fruits and vegetables from photos
• Provide nutritional information about produce
• Offer personalized health recommendations based on user-selected conditions
• Track scan history and favorites

Medical Disclaimer

The nutritional information and health recommendations provided by FreshScan are for informational purposes only. They should not be used as a substitute for professional medical advice, diagnosis, or treatment.

Always consult with a qualified healthcare provider before making dietary changes, especially if you have a medical condition such as diabetes, kidney disease, or heart disease.

Accuracy of Information

While we strive for accuracy, FreshScan's AI-powered identification and nutritional data may contain errors. We do not guarantee:

• 100% accuracy in produce identification
• Complete accuracy of nutritional information
• Suitability of recommendations for your specific health situation

Nutritional values may vary based on produce variety, ripeness, growing conditions, and other factors.

User Accounts and Subscriptions

Free Tier

Free users receive limited access to FreshScan features, including a restricted number of daily scans.

Premium Subscription

Premium subscriptions are billed through Apple's App Store and are subject to Apple's terms and conditions. Subscription details:

• Payment is charged to your Apple ID account at confirmation of purchase
• Subscription automatically renews unless canceled at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel subscriptions in your App Store account settings
• Any unused portion of a free trial period will be forfeited when you purchase a subscription

Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to reverse engineer or decompile the App
• Interfere with or disrupt the App's servers or networks
• Upload malicious content or attempt to gain unauthorized access
• Use the App to collect information about other users
• Resell or redistribute the App or its content

Intellectual Property

The App, including its content, features, and functionality, is owned by FreshScan and is protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our App without our express written permission.

Limitation of Liability

To the maximum extent permitted by law, FreshScan and its affiliates shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Any loss of profits, data, or goodwill
• Any damages resulting from your use or inability to use the App
• Any damages resulting from reliance on nutritional or health information provided
• Any damages resulting from incorrect produce identification

Indemnification

You agree to indemnify and hold harmless FreshScan, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising out of your use of the App or violation of these Terms.

Termination

We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination, your right to use the App will immediately cease.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
